Local Business Pro ("we," "us," "our") is built to help real local businesses communicate with their customers. This Fair Use Policy exists to protect all of our subscribers by ensuring that platform resources—including voice calls, SMS, AI-powered features, and automations—are used in a manner consistent with legitimate local business operations.
If you are running an honest local business and using the platform as intended, this policy will never affect you. It is designed solely to address patterns of activity that fall outside what any reasonable local business would generate.
1. What "Fair Use" Means
Each Local Business Pro subscription includes a generous allocation of platform resources—call minutes, SMS messages, AI executions, and automations—sized for the needs of a local business at your plan level. Fair use means utilizing these resources in a way that is consistent with the normal operations of a business of your type and size.
We understand that usage naturally fluctuates. A busy week, a seasonal spike, or a marketing campaign can all cause temporary increases. Occasional spikes in legitimate business activity are expected and are not a concern.
2. What We Monitor
To maintain platform quality and protect all subscribers, we monitor for activity patterns that are inconsistent with normal local business operations. These patterns may include, but are not limited to:
- Call volumes or durations that are substantially outside the norm for a business of your type and subscription level
- High volumes of international or long-distance calls that are atypical for a local service business
- Significant activity at unusual hours that does not align with your stated business operations
- Patterns suggesting the platform is being used as a call center, telemarketing operation, or bulk communication service rather than for genuine customer interactions
- AI or automation usage that appears designed to exploit platform resources rather than serve legitimate business needs
- Rapidly scaling usage in ways inconsistent with organic business growth
- Any activity that degrades platform performance for other subscribers
3. How We Determine Acceptable Usage
We evaluate usage in context. There is no single hard threshold that triggers a review. Instead, we consider the totality of your account activity relative to:
- Your subscription plan and its included resources
- The type and size of business you operate
- Typical usage patterns for businesses similar to yours on our platform
- Your historical usage trends and how quickly activity has changed
A plumbing company that receives 30 calls a day during a cold snap is using the platform normally. A single-location HVAC company generating the call volume of a 200-seat contact center is not.
4. What Happens If We Identify Unusual Activity
If we identify usage that appears inconsistent with this policy, we may, at our sole discretion, take one or more of the following actions:
- Contact you to discuss your usage and understand your business needs
- Temporarily limit or throttle specific platform features
- Require you to upgrade to a plan appropriate for your usage level
- Suspend access to certain services until the matter is resolved
- In cases of clear abuse or fraud, terminate your account in accordance with our Terms of Service
We prefer to work with our subscribers. In most cases, our first step will be to reach out and have a conversation. However, we reserve the right to take immediate action without prior notice when we believe activity poses a risk to platform integrity, other subscribers, or constitutes fraud or abuse.
5. Prohibited Uses
The following activities are expressly prohibited and may result in immediate account suspension or termination:
- Using the platform to operate a call center, telemarketing service, or bulk communication operation disguised as a local business
- Reselling or redistributing platform resources to third parties
- Using automated systems to generate artificial call volume or message traffic
- Exploiting AI features or automations in ways designed to circumvent usage limits
- Any fraudulent activity, including misrepresenting the nature of your business to obtain services
- Using the platform in violation of applicable telecommunications laws or regulations
6. Our Commitment
We are committed to being transparent and fair. This policy is not about penalizing busy businesses—it is about preventing abuse that could harm the experience for everyone on the platform. The vast majority of our subscribers will never be impacted by this policy.
If you have questions about whether your intended use falls within this policy, or if you anticipate a legitimate need to exceed typical usage levels, we encourage you to contact us in advance. We are happy to discuss your needs and find the right solution.
7. Changes to This Policy
We may update this Fair Use Policy from time to time to reflect changes in our services, technology, or business practices. We will post any changes on this page with an updated effective date. Your continued use of the Services after any changes constitutes your acceptance of the revised policy.
8. Relationship to Other Agreements
This Fair Use Policy is part of and subject to our Terms of Service. In the event of a conflict between this policy and the Terms of Service, the Terms of Service shall govern. All capitalized terms not defined in this policy have the meanings given to them in the Terms of Service.
