Zampi (“Zampi,” “we,” “us,” “our”) prioritizes your privacy. 

We have adopted this privacy policy (the “Privacy Policy”) to help our website visitors, users, current and potential customers, clients, their employees, our employees, and other business partners understand what Data we process, how and why we do so, and what your rights are regarding that Data. This Privacy Policy governs information we collect through our website, software and mobile website (collectively, “Site”) and information we collect from you or third parties through any other means to provide our services or perform other business activities (collectively, “Services”).   

This Privacy Policy applies only to data collected by Zampi through the Site and Services and does not apply to our privacy practices with regard to data we process on behalf of companies for whom we perform work (“Clients”). For information about the collection, use, and disclosure of your information by our Clients or by us on behalf of our Clients, please review the relevant Client’s privacy policy.

Because of the nature of our Services, the term Data also includes the information, including personally identifiable information, you process from your customers and that you upload to the Services. We rely on your compliance with our Terms of Service, in which you represent and warrant that you have express permission to process your customer’s personal information. We hold all rights in and may use De-identified Data for our own purposes in any manner and without attribution or compensation to any person. 

Please carefully read this Privacy Policy, which is part of our Terms of Service, before using our Site and/or Services. If you do not agree with the Terms of Service and/or this Privacy Policy, you must refrain from using our Site and/or Services. By accessing or using our Site and/or Services you agree to our use of your information consistent with the Terms of Service and this Privacy Policy.

Communications 

By registering and using the Services, you consent to Zampi sending you communications and marketing materials related to services or products provided to you by Zampi or that may otherwise be of interest to you, including services or products of our partners or third parties. You will have an opportunity to opt-out of receiving marketing communications by following the instructions provided in the communication.

We occasionally update this Privacy Policy to reflect changes in our products and services and customer feedback, or if required by applicable US law. When we post changes, we revise the “last updated” date at the top of this statement. Your use of the Site is subject to the then effective Privacy Policy.

2. CONFLICT BETWEEN THIS POLICY AND LOCAL LAWS AND REGULATIONS

When local laws and regulations require a higher level of protection for your Personal Information, they take precedence over this Privacy Policy. In addition, the specific requirements of this Privacy Policy apply only when local laws and regulations permit.

Collection of Personal Information

We have the capacity to gather data that either directly identifies you or is associated with you (“Personal Information”). This may encompass details like your name, email address, mailing address, service addresses, phone numbers, identity-authentication particulars (found on a government-issued ID or passport), additional contact details, and any information you provide us through the Services, both during the registration of your account and subsequently.

• • Audio, electronic, visual, thermal or similar information such as call recordings, chat transcripts, and email correspondence.

• • Geolocation data such as non-precise geographic location indicators from mobile devices, websites, and service addresses;

• • Inferences drawn from other Personal Information or data that relate to your preferences, interests, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes, including credit reports and scores; and

• • Personal information as described in Cal. Civ. Code § 1798.80(e) to the extent collected under another category of Personal Information above.

Some of the Personal Information listed above may be considered Sensitive Personal Information under relevant privacy laws. This includes Zampi or Local Business Pro account login credentials. Each type of Sensitive Personal Information may overlap with a category of Personal Information listed above. The type of Personal Information we collect about you may vary based on how you use our Sites and/or Services and your relationship with us.

Further, Personal Information may include information processed when you sign up, login to your account, or otherwise link to your account through Facebook, Google, Microsoft/Bing, or Apple, including registration and profile information. When you link third-party platforms such as Facebook, Google, Microsoft/Bing, and Apple to the Services, you authorize us to process any Data the third-party platform may give us (i.e. email address, username, etc.); and, all of such data is considered Personal Information. Please note that any third-party platform you link to the Services likely has its own privacy policy that governs its use and processing of your data. Please refer to any applicable third-party privacy policy for information regarding their use and processing of your information. 

Usage Data and Site Activity

As you navigate through our website, we automatically gather information related to your interactions on the platform (“Usage Data”). This encompasses details such as the web browser and device types you utilize, device ID, operating system and version, IP address, internet service provider, pages visited, referral and exit pages, date and time of your visit, as well as the number and duration of clicks both to and from the Site.

This collected data serves various purposes, including estimating audience size, understanding usage patterns, identifying returning visitors, storing preferences, tailoring our site to align with your interests, and expediting search processes. Should the automatically collected data have the potential for direct or indirect association with you, we treat it as Personal Information falling under the categories of Identifiers or Internet or other electronic network information, as applicable. Conversely, if the information cannot be individually linked to you, it is categorized as Usage Data.

Communication Recordings

We may record calls and retain the content of text messages, chat transcripts, or other written/electronic communications between you and us. By communicating with us, you consent to our recording and retention of communications.

4. HOW WE COLLECT INFORMATION

Information Collection From User

We collect information from you when you use the Site with or without registration, upon registration, and when you use our Services. You are not required to provide us your Personal Information; however, if you choose not to provide the requested information, you may not be able to use some or all of the features of the Site or Services or we may not be able to fulfill your requested interaction. You are responsible for ensuring the accuracy of the information you submit to Zampi in connection with your use of the Site. You are also responsible for the use of your password and its use by anyone to whom you disclose it or who obtains from you.

Third-Party Personal Information Sources

We may collect Personal Information from third-party data sources such as the Clients we serve.

Cookies and Other Automated Tools

At Zampi, we engage third-party advertising and analytic services to gain insights into your interactions with the Site. Through the use of “cookies” – text files placed on your computer – both Zampi and these services anonymously collect standard Internet log information and details about visitor behavior. The information generated by these cookies, including your IP address, is transmitted to service providers for the purpose of assessing your engagement with the Site. This data is then utilized to create statistical reports on website activity and audience data for Zampi. Additionally, these services can provide insights into the relationship between your ad impressions, other uses of ad services, and interactions with these ad impressions and services in relation to visits to our website.

You have the option to either accept or decline cookies. Although most web browsers are set to automatically accept cookies, you can adjust your browser settings to reject them. It’s important to note that rejecting cookies by modifying your browser settings may disable certain functionalities on our Website.

Furthermore, Personal Information and/or Sensitive Personal Information may be utilized in ways communicated to you at the point of collection, with your explicit consent, or as mandated or permitted by applicable laws.

Service Providers

We may disclose your Personal Information to other businesses (“Service Providers”) to provide services to us or on our behalf. Categories of service providers we use include:

– Fulfillment and account servicing vendors, which help us provide products, services and information to you, and service your account or benefits;

– Payment processors, which help us to accept and process the payments for our products/services to you;

– Marketing and communications vendors, which help us market our products/services to you, and conduct outreach campaigns;

– Research and development vendors, which help us develop and improve our products and services;

– Data and business analytics vendors, which help us collect, analyze, and improve the accuracy of our data (including Personal Information);

– IT and network administration vendors, which provide services such as data storage and management, website hosting, and data security;

– Professional service firms, which provide accounting, legal, auditing, and other professional services; and

– General service providers, which help us with day-to-day business operations such as office support services, courier services, facilities management, and document destruction.

We require each Service Provider to use reasonable security measures appropriate to the nature of the information involved to protect your Personal Information from unauthorized access, use, or disclosure. Service Providers are prohibited from using Personal Information we provide to them other than as specified by us.

We disclose the following categories of personal information for a business purpose: Identifiers/Contact Information, Commercial information, Internet or other electronic network activity information, geolocation, visual and audio information, and inferences drawn from the above.

Third-Party Sale and Sharing‍

We affirmatively refrain from selling or sharing your Personal Information, specifically for targeted or cross-context behavioral advertising purposes, with companies that do not provide services to us.

Disclosure to Other Third Parties

On occasion, we may disclose your Personal Information to Third Parties for various purposes, including but not limited to:

‍‍AI Models & Your Data 

Zampi uses various 3rd party AI models to provide the best experience for the businesses and the customers that use Zampi’s Local Business Pro software. To ensure fluid communication, Zampi will share business information such as business hours, business services, etc. and conversation details such as the transcript or audio files with third party AI models. Our users do not have the ability to opt-out of sharing data with the AI models that we use. We have selected trustworthy AI service providers  who protect sensitive data shared with them. In addition to protect our user’s privacy, we have limited the amount of data that we share with these AI service providers and the amount of control they have over your data. For example, a third party AI service provider’s AI will never be able to access any 3rd party integration directly but only with our system. 

User Consent: 

We do not require our users to give us explicit consent to share their information with our AI service providers because our entire application is built around the purpose of integrating AI into our user’s business. We believe that because of the nature of our business and our application that it is inherently understood that AI models will have access to their information.

Zampi utilizes various Google services to enhance user experience and integrate functionalities that make our Services more efficient and user-friendly. In line with our commitment to transparency and privacy protection, this section outlines our practices regarding the access, use, storage, and sharing of Google user data. Zampi’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Access and Use of Google User Data:

Zampi’s application accesses Google user data only after obtaining explicit consent from you. This access is strictly limited to the purposes of providing services you have registered for or to enhance our application’s functionality. The types of Google user data we may access include, but are not limited to:

• Google Calendar events to sync with your Zampi account for better schedule management.
• Google Drive documents to allow direct import and export functionalities within Zampi’s services.

We use Google user data solely for the service provision as described in our Privacy Policy and do not share this data with any third parties except as necessary to provide the services requested by our users or as required by law.

Storage of Google User Data:

Any Google user data accessed by Zampi is stored securely and is protected against unauthorized access and use. We store this data only for as long as it is necessary to provide the services to our users or to comply with our legal obligations.

Sharing of Google User Data:

Zampi does not share Google user data with third parties except in the following circumstances:

• With your consent.
• With service providers acting on our behalf to provide the services you’ve requested, under confidentiality agreements.
• When required by law, such as to comply with a subpoena, or similar legal process.

Your Choices and Controls:

You have control over the Google user data our application accesses. At any time, you can revoke our application’s access to your Google account by visiting the Google security settings page. Additionally, our application provides in-product privacy notifications to further explain how and why we access your Google user data.

Compliance and Cooperation with Google Policies:

Zampi adheres to Google’s policies regarding the access, use, storage, and sharing of Google user data. We regularly review our practices to ensure compliance and cooperate fully with Google in the event of data audits.

Visibility and Accessibility:

This Privacy Policy, including the section on Google user data, is hosted on the verified domain of our website, making it easily accessible and visible to all users. It is prominently linked from the homepage of our application and the OAuth consent screen on the Google Cloud Console, ensuring that the privacy policy URL matches across all platforms as required by Google.

You have the right to request that Zampi delete any of your Personal Information we have collected from or about you. We may not delete your Personal Information if Zampi:

– Needs to retain the personal information to comply with applicable law, exercise our rights, detect and protect against fraudulent and illegal activity, or comply with other legal obligations;

– Uses the personal information internally in a manner that you have authorized or is reasonably within your expectations as a consumer, such as if we need to complete a transaction for you.

Right to Correct

You have the right to request that we correct inaccurate Personal Information we maintain about you. After you request to correct inaccurate Personal Information, we will provide instructions for you to provide us with optional documentation to support your request and we will consider it. We may decline to correct your Personal Information if we determine that your request is fraudulent or abusive or if we determine, based on the totality of the circumstances, that your correction is more likely inaccurate than accurate. How to Exercise Your Rights

If you submit your request via email, please include at least your name, mailing address, email address, and a description of your request. We will confirm receipt of your request within 10 business days.

After you submit your request, we may contact you to obtain additional information necessary to verify your identity. For example, we may require you to verify certain information in our files or submit a signed declaration under penalty of perjury verifying your identity. We will not process your request without verifying your identity, so please respond promptly. If you do not timely respond to our requests for information, we may deny your request.

We will process verified Right to Know, Deletion, and Correction requests within 45 days of receipt, subject to any applicable exemptions and extensions permitted by law up to 90 days. If you have an online account with us, we will provide the response to your request via the online account, otherwise, we will give you the option to choose between mail and electronic delivery.

Authorized Agent

If you are an authorized agent submitting a request on behalf of a California resident, you must provide a copy of a lawful power of attorney or a written signed authorization from the consumer along with proof of your identity. You may provide this documentation via email to hello@zampi.io after submitting the request. We may contact you and/or the consumer on whose behalf you claim to act to verify your authorization.

We will not discriminate against any consumer for exercising their privacy rights under law or this Privacy Policy.

California “Do Not Track” Disclosure

Do Not Track is a web browser privacy preference that causes the web browser to broadcast a signal to websites requesting that a user’s activity not be tracked.  At this time, our Site and Services do not respond to “do not track” signals, which means that we may process information about your online activity both while you are using the Services and after your use of the Services. 

Information From Minors

We do not knowingly collect, utilize, or disclose information from individuals under the age of 16. Should we become aware that we have inadvertently obtained personal information from a child under 16, or the applicable minimum age in a specific jurisdiction (e.g., 13 in the United States per the Children’s Online Privacy Protection Act), we will promptly take measures to delete such information.
